What is the Disability Tax Credit?

The Disability Tax Credit (DTC) is a non-refundable tax credit in Canada used to reduce income tax payable on the income tax and benefit return. A person with a severe and prolonged impairment in physical or mental functions may claim the disability amount once they are eligible for the DTC.

Who is eligible for the Disability Tax Credit?

Eligible candidates for the Disability Tax Credit must have prolonged impairment in physical or mental functions that have lasted or are expected to last for at least 12 months. A qualified practitioner must confirm that the impairment is severe and prolonged. Qualified practitioners include doctors, optometrists, occupational therapists, psychologists, physiotherapists, audiologists, and speech-language pathologists.

My disability has prevented me from obtaining employment. Am I still able to apply for the Disability Tax Credit even if I don’t have a taxable income?

Yes. If you have low or no income, you still qualify for the Disability Tax Credit and Registered Disability Savings Plan (RDSP). To make use of the non-refundable tax credit, you can transfer the credits to supporting family members to reduce their taxable income. Once approved, low or no income-earning individuals are also eligible for a government bond of $1,000 a year, for up to 20 years ($20,000).

I have a high income, am I still eligible for the Disability Tax Credit?

Yes, all income levels are eligible.

Can my child who is under 18 years of age claim the Disability Tax Credit even if she/he does not have a taxable income?

Yes. Parents of children with disabilities can apply on behalf of their children. If you are applying on behalf of your child, there are additional amounts granted by the Canadian government that you are eligible to receive, such as the Child Disability Benefit and the Registered Disability Savings Plan (RDSP).

Can I apply for a family member?

Yes, it is not uncommon to assist a family member.

I have had a disability since birth. Is the Disability Tax Credit retroactive?

Yes. We can file up to 10 years of retroactive tax returns.

What benefits can I expect, once approved?

You could receive up to $40,000 in benefits to assist you with your disability. Benefits can be retroactive to provide you with even more assistance in living with your disability.

How long does it take to receive the Disability Tax Credit? Will I have to pay taxes on the money I receive?

Once your claim is submitted to the CRA, the process may take up to 6 months; however, the average time is approximately 16 weeks. You will not have to pay taxes on the money you receive, as it is non-taxable.

I have already applied for the Disability Tax Credit but was denied, should I still contact you?

Yes. The application process can be overwhelmingly complicated and difficult to complete properly. If you have been previously denied for the Disability Tax Credit, we will review your file to see that you were fairly dealt with, and will help you reapply for these tax credits. We promise to do our best to rectify the situation regarding any former claim denials.

If I am deemed eligible for the Disability Tax Credit, will it affect my chances of getting approved for other government loans, such as OSAP?

No. Any money that you receive has no effect on you eligibility for other government loans.

Will applying for the Disability Tax Credit affect my Ontario Disability Support Program (ODSP) assistance?

No. The Disability Tax Credit aims to help you get back the income taxes that you have paid, while the ODSP helps the disabled Canadian’s with low incomes to meet basic financial requirements.

Does my doctor need to complete any forms?

A qualified practitioner must authorize all sections of the form. Qualified practitioners include doctors, optometrists, occupational therapists, psychologists, physiotherapists, audiologists, and speech-language pathologists.

Does the severity of my condition impact how much I can receive?

No, however, factors such as age, province of residence, marital status, overall tax situation, and the number of years in which you qualify for the benefit, will affect the size of your refund.
